PROCESSING OF PERSONAL DATA CLARIFICATION TEXT

Pursuant to Article 10 of the Law on Protection of Personal Data numbered 6698 (“KVKK”), titled 'Informing Obligation of Data Controller', our company, Tarımsan Tarım Sanayi ve Ticaret A.Ş. (“Tarımsan”) as being data controller, is obliged to inform the personal data owners about; the purposes of processing personal data, the persons to whom the personal data is transferred and the purposes of the transfer, the legal reasons and methods of the collection of personal data and the rights listed in Article 11 of the KVKK which the personal data owner will direct to the data controller.

Pursuant to this article, this Clarification Text has been prepared for the purpose of enlightening you, the data owners, in accordance with the provision of Article 10 of the KVKK.

1. Identity of Data Controller:

In article 3/1 (ı) of the KVKK, data controller is defined as “real or legal persons who determine the purposes and means of processing personal data and are responsible for the establishment and management of the data recording system”. In Article 10/1 (a) of the KVKK titled "Informing Obligation of the Data Controller", it has also brought the obligation to inform the data owner about the identity of the data controller.

Tarımsan may have the title of "data controller" within the scope of KVKK due to your personal data that you share with us both on this website and in other channels. In this context, the identity of the data controller is as follows: Tarımsan Tarım Sanayi ve Ticaret A.Ş., a Turkish joint stock company registered with the Gebze Trade Registry with the registration number 1337 and Mersis number 0824003044600012 and situated at the address of İstasyon mh., Beyazıt cd., no.:24, Gebze/Kocaeli.

2. Purposes of Processing Personal Data:

Your personal data is processed in accordance with the personal data processing principles specified in Article 4 of the KVKK, based on one or more of the personal data processing conditions specified in Article 5 of the KVKK. In all personal data processing activities carried out by Tarımsan, we act in accordance with the obligations sought in all relevant legislation, especially the KVKK.

Purposes of processing your personal data, in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK, is to enable our business units to make the necessary efforts to make you benefit from the products and services offered by Tarımsan, to customize such products and services in line with your needs and to determine and implement Tarımsan's commercial and business strategies accordingly.

3. To Whom and For What purpose the Processed Personal Data Can be Transferred:

For the necessary work to be performed by us to make you benefit from the products and services offered by Tarımsan and for the sales and marketing of Tarımsan products on this website, customization and recommendation of the products and services offered by Tarımsan according to your preferences, usage habits and needs and recommended to you by Tarımsan and determining and implementing the commercial and business strategies of Tarımsan, we may transfer your personal data to our group companies, business partners, suppliers, shareholders, personnel and managers, legally authorized public institutions and private individuals within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK.

4. Method and Legal Reason for Collecting Your Personal Data:

Your personal data is collected and processed by Tarımsan through different channels and in accordance with the laws, including the registrations you make with the use of this website, the forms filled by you and the contracts you have concluded with Tarımsan in order to carry out our commercial activities. Your personal data can also be processed and transferred for the purposes specified in this Clarification Text within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK.

5. Rights of Personal Data Owner:

Within the scope of KVKK, you have the right to obtain information about the existence of your personal data recorded by Tarımsan, to see your existing personal data, to learn with whom it has been shared and to request that it be deleted or changed when necessary. Tarımsan will finalize the request as soon as possible and within thirty (30) days at the latest, depending on the nature of the request.

If the information you request from Tarımsan regarding your personal data requires an additional cost, this information will be provided on condition that the fee in the tariff determined by the Personal Data Protection Board is paid. The rights of natural persons whose personal data are processed pursuant to Article 11 of the KVKK are as follows:

• Learning whether personal data is processed or not,
• If personal data has been processed, requesting information about it,
• To learn the purpose of processing personal data and whether they are used in accordance with the purpose,
• Knowing the third parties to whom personal data is transferred in the country or abroad,
• Requesting correction of personal data in case of incomplete or incorrect processing and requesting notification of the transaction made within this scope to the third parties to whom the personal data has been transferred,
• Requesting the deletion or destruction of personal data in the event that the reasons requiring processing are eliminated, although it has been processed in accordance with the provisions of the KVKK and other relevant laws, and requesting the notification of the transaction made within this scope to the third parties to whom the personal data has been transferred,
• Objecting to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems,
• Requesting the compensation of the damage in case of loss due to unlawful processing of personal data.

6. Right of Choice

We would like to benefit from your personal data in order to inform you about our products and services, without prejudice to what we have recorded due to legal obligations and our contractual relations. It is at your discretion to allow us to use your personal data for this purpose. If you do not give your consent or if you want to withdraw the consent you have given before, your information will be closed to access and their use for these purposes will be terminated.
